Welcome to TaleemTalk, a mobile application and website (https://taleemtalk.com/) operated by TaleemTalk, a company based in Dubai, United Arab Emirates ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of the TaleemTalk mobile application (the "App"), the website (the "Site"), and any related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Services.
1. Acceptance of Terms
By downloading, installing, or using the App, accessing the Site, or engaging with the Services, you confirm that you are at least 21 years old (the age of majority in the UAE) or have the consent of a parent or guardian if under 21, and you have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Services
TaleemTalk is an educational platform connecting users with educational content, resources, and communities. The Services may include in-app subscriptions for premium content, community interactions, and personalized learning experiences. We reserve the right to modify, suspend, or discontinue any part of the Services at any time without prior notice, subject to applicable UAE laws.
3. In-App Subscriptions
3.1 Subscription Plans
The App offers in-app subscriptions for access to premium features or content ("Subscriptions"). The available Subscription plans are as follows:
- Monthly Plan
- Title: Monthly
- Length of Subscription: 1 Month
- Price: $1.99 USD per month
- Annual Plan
- Title: Annual
- Length of Subscription: 1 Year
- Price: $14.99 USD per year
Subscription details are also provided within the App at the time of purchase. Subscriptions are managed and processed through the Apple App Store or Google Play Store, in compliance with their respective terms (Apple: https://www.apple.com/legal/internet-services/itunes/, Google: https://play.google.com/about/play-terms.html).
3.2 Payment and Billing
- Payment Processing: All payments for Subscriptions are handled by Apple (for iOS) or Google (for Android) and are subject to their payment terms. Payment will be charged to your iTunes Account at confirmation of purchase. We do not store or process payment card information directly.
- Automatic Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the applicable subscription price ($1.99 USD for Monthly, $14.99 USD for Annual).
- Managing Subscriptions: You can manage or turn off auto-renewal in your Account Settings after purchase via your Apple App Store or Google Play Store account settings. Cancellation of the current subscription is not allowed during the active subscription period.
- No Refunds: Subscription fees are non-refundable, except as required by UAE consumer protection laws (e.g., Federal Law No. 15/2020 on Consumer Protection) or app store policies. If a Subscription fails to function correctly, contact us at support@taleemtalk.com, and we will investigate promptly.
- Price Changes: We may adjust Subscription prices, with notice provided through the App or app store. Continued use of the Subscription after price changes constitutes your consent to the new pricing.
3.3 Free Trials
We may offer free trial periods for Subscriptions. Billing information may be required at signup. Unless canceled before the trial ends, you will be charged the applicable Subscription fee ($1.99 USD for Monthly, $14.99 USD for Annual). We may modify or terminate free trial offers at our discretion, with notice where required by UAE law.
4. User Accounts
To access certain features, you must register for an account ("Account"). You agree to:
- Provide accurate, complete, and current information during registration.
- Keep your Account information updated.
- Maintain the confidentiality of your Account credentials.
- Notify us immediately of any unauthorized use at support@taleemtalk.com.
We may suspend or terminate your Account for violations of these Terms or UAE laws, including Federal Decree-Law No. 45/2021 on Personal Data Protection.
5. User Conduct
You agree not to:
- Use the Services for illegal or unauthorized purposes under UAE laws, including Federal Law No. 34/2021 on Combating Rumors and Cybercrimes.
- Post or share content that is defamatory, harassing, obscene, or violates intellectual property, privacy, or UAE cultural norms.
- Attempt to interfere with the Services’ security or functionality, including introducing malicious code.
- Collect or process personal data without authorization, in violation of UAE data protection laws.
We may remove content or terminate access for violations without notice, subject to UAE legal requirements.
6. Intellectual Property
All content, features, and designs within the Services are owned by or licensed to TaleemTalk and protected by UAE intellectual property laws (e.g., Federal Law No. 38/2021 on Copyrights and Neighboring Rights). You are granted a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes. You may not copy, modify, or distribute the Services without our written consent.
User Content
Content you submit ("User Content") remains your property. By submitting User Content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute it in connection with the Services. You represent that you have the rights to share User Content and that it complies with UAE laws.
7. Third-Party Services
The Services may integrate with third-party services (e.g., Apple Pay, Google Pay, or analytics providers). Your use of these services is subject to their terms and privacy policies. We are not responsible for third-party practices or content.
8. Termination
We may terminate or suspend your access to the Services for violations of these Terms or UAE laws, with notice where required. Upon termination, your right to use the Services ceases, and Subscription fees are non-refundable, subject to app store policies or UAE consumer protection laws. You may terminate your Account by discontinuing use or contacting support@taleemtalk.com.
9. Limitation of Liability
To the extent permitted by UAE law, TaleemTalk and its affiliates shall not be liable for indirect, incidental, or consequential damages, including loss of data or profits, arising from your use of the Services. Our total liability is limited to the amount you paid for the Services or AED 500 if no payment was made, unless otherwise required by UAE law (e.g., Federal Law No. 15/2020).
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the United Arab Emirates, as applied in the Emirate of Dubai. Disputes shall be resolved through the courts of Dubai, UAE, unless otherwise agreed. You waive the right to participate in class actions, to the extent permitted by UAE law.
11. Changes to These Terms
We may update these Terms, with notice provided via the App, Site, or email, as required by UAE law. Continued use after changes constitutes your acceptance of the updated Terms.
12. Compliance with UAE Laws
Your use of the Services must comply with all applicable UAE laws, including but not limited to:
- Federal Decree-Law No. 45/2021 on Personal Data Protection.
- Federal Law No. 15/2020 on Consumer Protection.
- Federal Law No. 34/2021 on Combating Rumors and Cybercrimes.
- Federal Law No. 38/2021 on Copyrights and Neighboring Rights.
